Your rights under Australian Consumer Law come first
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies those rights. Where anything below appears to limit our liability or your ability to make a claim, it applies only to the extent the law allows.
Who you are buying from
Tile Clearance is a trading name of McLee Tile Supply Pty Ltd, ABN 48 662 380 743. Every sale of goods is made subject to these terms and conditions of sale. The entity name and ABN appear on the tax invoice emailed with every order.
Prices and the countdown
All prices are in Australian dollars and include GST. Prices follow a published daily cycle: every line sells at its lowest price between 10am and 10pm Brisbane time, resets to its recommended retail price at 10pm. No line is sold at less than half off its recommended retail price. The cycle is the same every day and applies equally to every customer at any given instant.
The price you are charged is the price displayed when your checkout price lock begins. That lock holds for 10 minutes. If the countdown moves while you are paying, it does not change what you pay. Prices in a cart that has not entered checkout are live and will move with the countdown.
Payment processing fees are absorbed into our prices and no payment surcharge is applied at checkout. After full payment has been received, the order will be packed and delivered as soon as practical.
The goods
Tile Clearance offers end of line, discontinued and clearance stock. Every line is finite and is rarely restocked. Quantities shown on the site are live and can change while you are browsing. Odd Lots are sold as one indivisible quantity to a single buyer and cannot be split.
It is the responsibility of the purchaser to ensure that the goods purchased are suitable for the purpose for which the ultimate user intends to use them; that the method by which the ultimate user proposes to install the tiles is satisfactory for the purpose intended; and that quantities ordered are as required. Final quantities are the responsibility of the purchaser. The wastage allowance offered by our calculator is a recommendation only, and because stock is rarely restocked a shortfall may not be able to be filled later.
Orders of different batches inherently contain shade variation. Tiles are a kiln-fired product and carry inherent characteristics including batch variation and crazing. Natural stone products, being limestone, marble, granite and slate, are natural products and vary accordingly; we recommend that natural stone tiles be sealed.
Product photographs are published exactly as supplied by the manufacturer, without colour correction, and can vary between screens, monitors and lighting conditions. We do not sell samples. Where an exact shade is critical, we recommend ordering a single box before committing to the full quantity.
Delivery
Freight is quoted before payment and is calculated per despatch origin. Where an order contains lines held at different warehouses it will arrive as separate deliveries, and you will be told this before you pay.
Deliveries are made kerbside by tailgate truck and pallet jack, and require reasonable truck access, a flat surface, and a person present to receive the goods. Drivers are not able to carry goods inside, upstairs, or beyond the kerb. Placement beyond kerbside, or forklift assistance, is arranged separately and charged at quote. Deliveries that cannot be completed because access or a receiver is not available may incur a redelivery fee charged by the carrier and passed on at cost.
All deliveries are undertaken by third party providers and are subject to those providers' terms and conditions. Delivery timeframes given at checkout are the carrier's estimates and are not guaranteed.
Checking your delivery
It is the responsibility of the purchaser to check all goods on receipt. Please inspect your delivery before signing for it, and note any visible damage on the carrier's documentation at the time of delivery. Signing a clean delivery receipt for damaged goods makes a freight claim substantially harder to pursue.
Claims for shortages or tile imperfections must be made in writing within two (2) days from the date of receiving the goods.
Once tiles have been laid, claims regarding tile imperfections, shade variation, marks or staining cannot be assessed. Tiles are fragile and due care is required in handling and laying them.
Warranty
We warrant the tiles we sell against manufacturing defects for 10 years from the date of purchase, where the tiles have been stored, handled and installed in accordance with Australian Standard AS 3958.1 by a suitably qualified installer. This warranty does not cover damage caused by installation, substrate movement, unsuitable adhesives or sealants, impact, abrasive cleaning, or use in an application the tile is not rated for.
This warranty is in addition to, and does not limit, your rights under the Australian Consumer Law.
Returns
Because we sell end of line, discontinued and clearance stock, returns after goods are received are accepted only for faulty goods, as required by the Australian Consumer Law. We do not offer change-of-mind returns.
Faulty goods must be returned in closed boxes. Goods that are flat stacked will not be accepted. Pallets must be wrapped and packaged in the same condition as delivered. Goods must be returned within seven (7) working days of delivery. An additional transport charge applies for collection, and any goods missing when an order is returned will be charged in full.
First-grade guarantee. If any product supplied is not first-grade stock as described, we will refund it in full including freight.
Things we cannot be responsible for
Subject always to the Australian Consumer Law, Tile Clearance is not liable for expense or injury arising from the use of any product supplied, and shall not be liable for any failure to perform or delay in performance due to strikes, fires, explosions, floods, riots, lockouts, injunction, interruption or delay of transportation, accidents, inability to obtain supplies, war, pandemics, governmental action or other circumstances beyond our control.
Price matching
We do not price match delivery charges, other clearance, run-out or liquidation offers, or products sold as second grade or B grade. Where you believe you have found identical first-grade stock at a lower price, contact us and we will review it, but we make no commitment to match.

How we collect, use and store your personal information is set out in our privacy policy. We do not sell your information. Marketing email is sent only where you have opted in, and every message carries a working unsubscribe link.
