Your rights come first

The benefits conferred by this guarantee are in addition to, and not in substitution for, any other rights and remedies given to consumers in relation to goods under the Australian Consumer Law and are subject to the terms and conditions below.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing on this page limits that.

What it covers

This guarantee only applies in relation to products marked ‘first quality’ by the tile manufacturer. Every line currently on this site is first grade. If we ever list seconds or a job lot, the product page will say so plainly and this warranty will not apply to it.

Check before you lay

The act of laying the material means the material is accepted for décor, shade, quality, type and size. No claim will be accepted once the material is laid.

Fixing of the product constitutes acceptance of the product.

Tiles with obvious manufacturing defects should not be laid. Once the tiles have been laid, liability will not be accepted for shading or obvious visual faults.

Installation

Certain defects which may become apparent after installation can be related to how the tiles were installed or to the supporting structure and materials. Ceramic tiles must be fixed in accordance with the relevant fixative manufacturer’s instructions and/or AS 3958.1-1991 “Guide to the Installation of Ceramic Tiles”. This guarantee will not cover situations where it cannot be satisfactorily demonstrated that substrate materials and fixatives are fit for purpose and have been correctly used.

Order extra

We advise customers to purchase 5 to 15% additional quantity so as to allow for tiles which are damaged during or after installation. tileclearance.com.au does not guarantee the availability of replacement tiles of the same colour or pattern after the time of purchase. On clearance stock this matters more than usual: when a line sells out it is gone, and the same batch cannot be reordered. The calculator on every product page adds wastage for you.

Slip

All ceramic tiles can be slippery when wet. Liability will not be accepted for accidents due to inappropriate tile selection, maintenance or carelessness. Where a manufacturer has published a slip rating we show it on the product page, but a rating is a laboratory result on a clean sample, not a promise about your floor. If the tile is going somewhere it will get wet, check the rating suits the job before you buy.

If you make a claim

If a purchaser makes a claim under this guarantee, tileclearance.com.au may, in its sole discretion, offer to either (i) replace the goods, or (ii) supply equivalent goods. Because our stock is clearance stock and lines are rarely restocked, an identical replacement often will not exist, in which case we will refund the affected amount rather than substitute something you did not choose.

Natural stone

This guarantee is not applicable to natural stone products.

That is the limit of our voluntary warranty, not the limit of your rights. Natural stone is a quarried material with variation, veining, pitting and fill that are characteristics rather than faults, which is why we do not offer a ten year promise over it. Your consumer guarantees under Australian Consumer Law still apply to stone in full, exactly as they do to porcelain.
